Our Rotten Roads...Fancy Suing Someone?

    It won't have escaped the attention of anyone in the Northern Hemisphere how bad the last couple of winters have been and, given that most governments have been cutting back on spending..

    .... I'm guessing that most of us will be seeing worsening road conditions in terms of holes, cracks, bad signage and so on... Where I am in SW England, the bits that aren't actually underwater are pretty awful.:mad::

    But if you crash, you can sue the Council, right? Well, yes, and then again, no.:eek:

    Interesting article. I wonder who I should complain to about the state of the M23 and M25.

    On the M23 there are long sections where the dividing line between lanes has split and there are some significant holes which can really throw the front wheel out of you hit them when moving across lanes.

    Similarly in the road works between the M23 and the M26 t has some pretty unpleasant overbanding ride in the middle of the lanes. Once again the front wheel can be thrown out by the uneven surface.

    It all makes for a stressful ride (not that either motorway is ever pleasant anyway :frown:

    I believe that Motorways are the domain of the Highways Agency...

    (Which is presumably why you see their blokes driving along in their high viz cars eating their sandwiches and pretending to be police officers..).

    Comes to something if even the M25 gets potholes..

    I remember several years ago in Sussex there was a guy that was killed on his bike after slipping on those tar lines that they were so found of putting down that way, and at the time he was being observed by a Police motorcycle instructor. I believe when this went to court even with the evidence given by the instructor the court still ruled that it was the riders fault.
    There was also the instance of the guy up north that lost his leg when he got hit by a foreign lorry that had partly crossed over to his side of the road and it was still deemed to be his fault due to him saying that he might have been close to center of the road.

    Excuse my language here but the court system in this country is a FECKIN joke :mad:

    Yes, those tar overbanding lines are bastards and they run practically all the way from the M23 to the M26. I've just sent an email to the Highways Agency about it and I'll keep you all updated if they reply.

    What they are still using overbanding!!! I thought they put a stop to that 5 years ago. Sussex County Council needs a very large boot up it's arse as I haven't come across it in any other county apart from there.
    Is it still mainly on the eastern side of the M23 then?

    It seems to be used along the M25 in the roadworks to cover up the cracks and joins. I didn't notice it too much on the Tiger but on the America it's a recipe for potential disaster.

    Right, a bit of an update from the Highways Agency.

    It seems there are 3 different companies involved in maintaining the areas of the M23 and M25 I complained about. I'm waiting to hear from one of them but I have responses from the other 2.

    My complaints about the ruts appearing on the M23 : the company say the road is inspected every 7 days for damage and they haven't found any Category 1 issues (the ones they consider a danger to the travelling public). I have written to them again pointing out what appears to be a bit of a dodgy surface that won't even be noticed by car drivers could be fatal to a biker. I'll let you know what they say.

    The M25 complaints : the company involved acknowledge the poor state of the road surface and are aware of serious problems but haven't been able to make repairs due to the weather. I replied that on my trip yesterday I noticed that some of the holes (especially towards the M26 junction) were really very large and asked when they would be dealt with.
