    Cheers bit late now sadly as we've already gone down that route. She's not been great on the communication of getting it sorted but appreciate it was a weekend.

    Update is the quack is giving me stronger meds for the pain as even stiffer today with neck and back pain.

    Sorry to hear of this, my friend. I hope you repair quickly and without any long-lasting effects. The bike can be sorted but your health is the most important thing.

    Hard luck mate, it's always a pain in the arse dealing with insurance, they all seem to move at their own pace. :rolleyes:

    The good news is you aren't badly injured, hopefully given a bit of time you will return to your daily bike commute. :cool:

    The game has definitely begun as the insured (as her insurance kept referring to her) has reported the incident but they've not taken details?? I've reported my claim directly to them and now need to wait as they follow up. My insurance (Swinton) isn't interested as my third party f & t doesn't cover me.

    Oh the joys.

    Just a quick update.

    Insurance turned out to great (so far) in promptly admitting clients liability and setting the ball rolling.

    Am going through the claims process for my kit as looking to have the majority replaced. Free legal advice I took confirms that after an accident they should replace it despite some having little or no damage as linings/structure (depending on the item) could have been compromised etc

    The Rocketship is dead sadly, with a 28% salvage cost to keep she sadly won't be getting a make over despite an Cat N advisory. The assessor was happy with photos only and an overview of the bike and accessories.

    I'm on a three lots of drugs and getting cabin fever but hopefully the pain will ease up in another week or two and I'll be able to start moving about more.

    Cheers mate.

    Feel that is worth knowing about your kit as not everyone will claim for minor scuffs etc but you're entitled to safe reliable kit if it's potentially compromised in an accident.

    Thanks @littleade, fortunately (well not really I suppose!) it's not my first gig with insurance having had a couple of non-liability incidents in the past.

    Great point on the insurance policy hadn't thought of that. I'd had some time on my hands so got a load of links and screen shots of bikes and managed to get a reasonable price. Was gutted they wanted 28% scrappage, seems very high but can't moan too much.

    Cheers for the overview, hopefully threads like this will help others should they be unfortunate to have to go down this road.

    I also learnt if liability is admitted don't use your insurance at all unless absolutely needed (e.g. legal advice) as this counts as using them as a service and can affect your renewal (the advisor admitted as much when I asked). They fell over themselves to get me in to hire and take up my claim.

    Further update. I'm boring myself with the process so well done if you're still with me!

    The insurance are getting cute replacing the gear. The lady told me "if it doesn't appear damaged then I wouldn't authorise a replacement"!? Anyway I educated her that motorcycle gear is basically safety equipment that can be compromised etc etc. The response was "we are a car insurance company"! F8ck me!!

    Anyway I've fired off an email outlining their responsibility to replace the kit, attaching an email from Oxford confirming the manufacturer advice.

    I also spoke to the excellent people at White Dalton solicitors (even speaking to the big man himself who writes columns for the mainstream magazines) who advised they are obliged to replace my kit. They also confirmed I'm not required to submit receipts as I only need to supply proof of ownership i.e. photos and the closest details to it's replacements but not betterment as @littleade alluded to (confusing legal terms haha).

    Cheers, yes they told me the equivalent newer model in not a betterment just a replacement if the older one is no longer stocked. The most interesting part was if you got a discount i.e. end of season etc they still need to replace with the equivalent value and not just give you what you paid. I'd never have thought that.

    Hi guys,

    Doing feck all else at the moment so thought I'd update (or bore) you with the latest. Well done if you get to the end!!

    The insurance company (the slippery bastardos) tried to make me an 'offer' on my kit around 50% of the replacement value also stating I had no receipts (NOT required) and some items didn't appear to have damage. They also wanted me to do all the work for them in sending them screenshots (not links as apparently there advisors can't access the internet!!??) of the replacement kit from the interweb. They thought they'd send me this 'offer' in an email letter despite my multiple conversations with them and assurances they'd call me to discuss.

    Anyway I resent them an email from Oxford backing the claims that my kit should be replaced as a safety item after an accident (this did prove key in my argument with them on the phone later). They tried the old wear and tear and not a new for old service blerb and increased the offer by £100. I phoned them and told them I wanted to speak to a manager or my solicitor would be in touch in regards to claiming the full cost of the kit. Advisor speaks to their legal team and they promptly change their tune to authorise replacements at cost. Job done.

    Now comes the promised 'loss of use' from the date of the accident to 7 days after the payment is issued for the write off. Hear nothing, so phone them again. They've now authorised this but wouldn't have if I didn't chase them but are refusing to pay for taxis for my GP appointments as the £15 daily loss of use apparently covers this?? I reminded them if I was in hire (as they call it) they'd be paying £100+ a day on a rental bike for a 1200cc. This doesn't wash so will pass this on to the solicitor for a decision.

    I'm very slowly on the mend but the documents back and forth between the solicitor and insurance are taking ages to get my physio started.
