Ah but its the government that decides the sentencing guidelines, there are other stakeholders in the loop but ultimately it rests with government, the courts do however look at both the mitigating and aggravating factors, along with a starting point ranging from say a fine to custody, it depends on a number of factors, however almost anything that crosses the community or custody bracket and the court will ask for a PSR, this sets out all relevant information to assist the court with sentencing, the PSR also gives a recommendation on sentence. There is an awful lot that comes into play, its a huge responsibility especially when a persons liberty is at stake, it may be a single parent with a child/children etc etc.
Better to put their hands in a vice and tighten very slowly until you hear cracking sounds,maybe not as the pricks would claim invalidity benefits for the rest of their lives
Happened to a chap I knew from school. Though as it was self inflicted oiling the chain of his bike, on its stand with the engine running and in gear, I didn't have a huge amount of sympathy.
Let us not forget that the Lord obliged us to "Love our Enemies .." and also that God's manner of judgement is perhaps uncomprehend able to ours. Best to leave it to God. He knows all things.
